Creed Isner was convicted of manufacturing intoxicating liquor,
and he brings error. Reversed.

The defendant, Creed Isner, was indicted and convicted for
unlawfully possessing "intoxicating liquor, to wit, 70 gallons of
grape wine."
The main facts on the trial below showed that the defendant had a
quantity of wild cherries and elderberries, and made an effort to
get from the state authorities a permit to make wine of them. The
berries were grown on his own farm. He put them into a barrel and
strained out the berries, having added about two gallons of water
to one gallon of juice. Having failed to secure a permit, he
placed the barrel containing the juice and water in an outside
cellar, where state police officers found it. The contents of the
barrels were not destroyed by the officers, but pint samples were
taken from said barrels. There is much disputed testimony as to
whether or not this concoction was fit for beverage purposes; a
number of witnesses saying it was so bitter that it could not be
drunk, and others saying that it tasted like wine. The pint
samples were analyzed, but the record does not show the alcoholic
content.
The defendant offered to show that the liquid was not
intoxicating, but objection to this evidence was sustained by the
trial court. There is no evidence that this concoction was made
for the purpose of being sold, but for home consumption, if it was
ever fit to be used for such.
In his brief, T. A. Brown, Esq., United States attorney, says:
"In order that the question may be settled squarely on the
construction of the last clause of section 29 (of the Volstead
Act), the government concedes here and now that the said wine was
not, as a matter of fact, intoxicating."
The government insists that the defendant is guilty, because the
jury found from the opinion of the police officers that the
concoction contained as much as one-half of 1 per cent. alcohol,
and contended that...

Doris Ruth Isner, age 84, of Kerens, died Tuesday, April 30, 2002,
at her home of cardiac arrest. She had been in declining health
the past three years.
Born August 14, 1917, at Cass, she was a daughter of the late
Charles E. Fuhrman and Ruth Jackson Fuhrman. On May 26, 1944, at
Green Bank, she was married to J. Herman Isner, who survives.
Also surviving are a brother, Robert Fuhrman, of Elkins; four
sisters, Mary Catherine Dahmer, Marjorie Eloise Riffle and Nina
Mae Polland, all of Elkins, and Anna Sue Beck, of Richmond,
Virginia. She was preceded in death by twin brothers, Charles
Edward and William Jackson Fuhrman, and two sisters, Mildred
Wilson and Helen Fuhrman.
She attended schools at Cass, graduated from Green Bank High School
in 1936, and earned her teaching degree from Davis and Elkins
College, having taught at Wildell, Salisbury and Clover Lick.
She was a Methodist.
Funeral service was conducted on Saturday afternoon at the Lohr
and Barb Funeral Home Chapel by the Rev. Donald L. Lockhart.
Interment followed at the Maplewood Cemetery at Elkins. |

J. Herman
Isner, 93, a well-known businessman and cattle farmer,
and a resident of Kerens, departed this life Saturday
evening, May 5, 2012, in Cortland Acres at Thomas.
He was born Monday, June 10, 1918, at Kerens, a son of
the late Jefferson W. and Icy Triplett Isner, sixth
generation descendent of Michael Isner, Revolution
veteran and pioneer settler of Randolph coming to
Randolf County, then Augusta in 1774 following Lord
Dunmores War. On mothers side great-great-grandson of
William Owen Triplett, rebuilder and designer of Mt.
Vernon for George Washington.
On May 26, 1944, at Green Bank, he was married to the
former Doris Ruth Fuhrman, who preceded him in death
April 30, 2002. |
They lived on his farm at Kerens,
where he was extensively engaged in the cattle business buying,
selling and raising quality cattle for his entire lifetime. He
estimated that he had bought and sold more than three million
cattle in 17 states. Although retired as to extensive travel and
trading, he still grazed between 600 and 800 steers, keeping 300
on his home farm and the balance on Virginia farms and
elsewhere. Mr. Isner was in the Armed Services during 1943 and
1944.
Over the years he has owned and showed American Saddle gaited
horses with considerable success and is widely known in show
horse circles.
In 1985, Mr. Isner placed his home farm, which is widely
recognized as one of the area's best farms, in a trust to be
maintained and operated as a model demonstration farm under the
operation and management of a Board of Trustees - information as
to practices available to the inquiring public. In this way, it
is the hope of Mr. Isner that the farm will be an inspiration to
the livestock producers of the future and will point the way to
practical economic livestock production.
In his long and varied career as a livestock dealer, farmer and
businessman, Mr. Isner said he had seen West Virginia go
backward as an agricultural state having at one time more than
three million cattle to our present five hundred thousand head
due mainly to our steep terrain which required hard work to
maintain and to the present grievous and ridiculous wetland laws
that will make a worthless swamp of our mountain valleys and
will create a very extensive expense when the future generations
lose their taste for the esthetic in favor of satisfying their
hunger.
Mr. Isner wishes to give credit for any success he may have had
to the inspiration and farseeing advice of his father, Jeff
Isner, without whose training his accomplishments would have
been very meager indeed. In his life-time, there is very little
that he would have done differently and he has enjoyed every
minute except the process of aging. It is his fervent hope that
he will have left the land in a better, productive state than he
found it; his philosophy is we are only tenants.
The family will receive friends at Lohr & Barb Funeral Home of
Elkins from 5 to 8 p.m. today. Final rites will be conducted at
the funeral home chapel, Wednesday, May 9, at 11 a.m. The Rev.
Lois Irons Kessler will officiate and entombment will follow at
the Isner Family Mausoleum at Kerens.

Mrs. Dowdy
passed away on October 30, 2013 at her home.
Janet Elaine Dowdy was born May 24, 1950 in Dallas, TX
to the late Warren Creed Isner and Betty Joyce Allen
Isner. She worked as a teacher for Tyler ISD, Taylor
Garden, Pine Tree and Martins Mill Schools.
Janet loved her horses, dogs, birds and all of nature.
She was a member of First Baptist Church in Ben Wheeler.
Survivors include her husband, Keenan Dowdy of Ben
Wheeler; 2 daughters, Kristan Heard and husband, Mike of
Tyler and Kathryn Anderson and husband, Ryan of
Cleveland; step-daughter, Hope Dowdy of Tyler; and 7
grandchildren. |
Memorial services for Janet Dowdy,
63, Ben Wheeler, are scheduled for 1:00 pm Saturday, November 9,
2013 at Hilliard Funeral Home. |

Wilford Curtis Isner, 75, a resident of Cherry Fork Road,
Montrose, departed this life Sunday morning, Dec. 14, 2003, at
the Davis Memorial Hospital. He had been in declining health
although death was unexpected.
He was born Tuesday, Dec. 4, 1928, at the Joe Curtis farm at
Montrose, the son of the late George R. Isner and Ruth C. Curtis
Isner, who survives at Cortland Acres Nursing Home at Thomas.
He was formerly married to Mary Louise Kirkpatrick, who
survives.
Also surviving are one son, Wilford C. Isner Jr. and wife,
Carolyn, of Clarksburg; two grandsons, Kurt and Bret Isner, both
of Clarksburg; one niece, Paula True Esser, and two nephews, Rod
and Danny True, all of the Chicago, Ill. area; and very special
neighbors, Harley and Ann Booth.
Preceding him in death besides his father was one sister, Vonda
Isner True; and one nephew, Kevin True.
Mr. Isner attended the schools of Randolph County, was a
graduate of Elkins High School and West Virginia University
where he received a bachelor of science degree in agriculture.
He was commissioned as a second lieutenant of the Artillery
Branch through the ROTC program.
He entered service in the U.S. Army at Fort Sill, Okla., during
1955. He graduated from the Army Aviation Program during 1956
and served primarily as an aviator and instructor pilot until
his retirement with the rank of major in 1975.
His overseas assignments included Korea, Germany, Hawaii and two
combat tours in Vietnam, where he flew and commanded a UH-1
helicopter unit.
His awards and decorations included the Bronze Star, the Air
Medal with several clusters and the Purple Heart.
After military retirement, he built a house on Cherry Fork Road
and operated a small wood stove business from 1978 until 1989.
He was a member of the H.W. Daniels American Legion Post 29,
Tygarts Valley Veterans of Foreign Wars Post 3647 and several
military associations.
Mr. Isner was a Methodist by faith and attempted to live by the
Golden Rule.
The family will receive friends at the Lohr & Barb Funeral Home
from 6 p.m. to 9 p.m. Friday. Final rites will be conducted at
the funeral home chapel at 1 p.m. Saturday. The Rev. Jonas
Johnson Jr. will officiate and interment will follow at the
Elkins Memorial Gardens, formerly the Independent Order of Odd
Fellows Cemetery, at Elkins, where presentation of the American
flag will be accorded by members of the H.W. Daniels American
Legion Post 29 and the Tygarts Valley Veterans of Foreign Wars
Post 3647. The family suggests that expressions of sympathy be
in the form of contributions to the Montrose Baptist Cemetery
Care Fund in care of Davis Trust Co., P.O. Box 1429, Elkins,
W.Va. 26241. The Lohr & Barb Funeral Home of Elkins is in charge
of the arrangements for Wilford Curtis Isner.

ARY LOUISE KIRKPATRICK ISNER, age 75 years, a resident of
Elkins, WV departed this life early Thursday morning, January
28, 2010 at the United Hospital Center at Clarksburg, WV. She
had been in declining health for the past three months.
She was born Tuesday, July 10, 1934 at Elkins, WV a daughter of
the late Luther Coy Kirkpatrick and Beatrice Eliza Chenoweth
Kirkpatrick. She was married to Wilford Curtis Isner, Sr. who
preceded her in death December 14, 2003.
Surviving are one son, Wilford Curtis “Will” Isner, Jr. and wife
Carolyn, Clarksburg; two brothers, Coy Kirkpatrick, Jr. and wife
Pat, Victoria, TX; John L. Kirkpatrick and wife Brenda, Elkins;
one sister, Anna Mae Poe and husband Dano, Moatsville; one
grandson, Bret Isner, Clarksburg, three nephews and one niece.
Preceding her in death are one infant sister and one grandson,
Wilford Curtis Isner, III.
She was a graduate of Elkins High School with the Class of 1952,
was a homemaker and attended the Elkins Church of God. She had a
passion for gospel music and praying for other people.
The family will receive friends at the Lohr & Barb Funeral Home
of Elkins from 4 to 7 PM, Saturday. Final Rites will be
conducted at the funeral home chapel, Sunday, January 31, 2010
at 2 PM. The Reverend Thomas Horn and the Reverend Will Isner
will officiate and interment will follow at the Elkins Memorial
Gardens at Elkins, WV. |
